Lomonosov (Arkhangelsk, Russia) AbstractThe paper focuses on the issue of solving conflicts of interest concerning the head of an entity within the Russian Federation. The legal rules aimed to solve conflicts of interest are in variance with the legal status of such high-ranking officials. This creates uncertainty, for instance in terms of his/her dismissal on these grounds. The author analyzed the concept of conflict of interest of the head of an entity within the Russian Federation, its nature and characteristics. A conflict of interest is a situation occurring when there is or may be a conflict between the personal interest of a high-ranking official and the rights and legitimate interests of citizens, organizations, society or the state, which involves a risk of infringing the rights and legitimate interests thereof. The author suggests some ways the institute of the conflict of interest can be adapted to the legal status of the head of an entity within the Russian Federation. These are: supervision by a special public authority; openness to public scrutiny; establishment of a special commission to resolve conflicts of interest; laying down the rules and requirements for self-monitoring of such officials. Further, the author specifies corpus delicti giving grounds for the president’s loosing trust in the official who fails to take necessary measures and prevent or resolve the conflict of interest entailing danger to society.
