Lomonosov; Investigative Committee of the Russian Federation in the Arkhangelsk Region and Nenets Autonomous Area (Arkhangelsk, Russia) AbstractThe paper dwells on modus operandi as an element of a crime and as a sign of a crime. Further, these legal categories are analyzed; their relationship is established; their structure is studied; and the role of modus operandi in each of them is determined. The author comes to the conclusion that modus operandi is an essential element of a crime. Still, it is usually considered to be only optional, secondary to corpus delicti, though adding to the social danger of the main crime.Keywordscrime, elements of a crime, modus operandi, actus reus, optional element of actus reusReferences
