Abstract

The paper dwells on modus operandi as an element of a crime and as a sign of a crime. Further, these legal categories are analyzed; their relationship is established; their structure is studied; and the role of modus operandi in each of them is determined. The author comes to the conclusion that modus operandi is an essential element of a crime. Still, it is usually considered to be only optional, secondary to corpus delicti, though adding to the social danger of the main crime.
